Canada Pension Plan Disability

We’ll help you get the benefits you deserve.

For many people with significant and permanent injuries, a disability claim under the Canada Pension Plan is one of their only available sources of income. The Plan allows for benefits to be awarded to disabled persons who meet the eligibility requirements because they have previously worked the required number of years and have paid premiums into the Plan, which are deducted from employees’ pay throughout Canada.

CPP awards benefits to eligible persons considered to have a “severe and prolonged” disability. You would need to have your doctor fill out a form which is submitted to CPP, along with your application form, setting out why they feel you should be awarded the benefit. The application will be considered by the government and a decision made as to your eligibility. Even if your claim is denied at first, there are several levels of reconsideration or appeal that may be available to you. These levels generally become increasingly more complex, but an experienced lawyer can help simplify the process.

We have represented many clients before various levels of the appeal process for disability benefits under the Canada Pension Plan. The process may involve appearing before a board or tribunal to argue the disabled status of the claimant. We can help you present your case so that you have the best chance of having the benefit awarded.
